1. Agreement to Terms
By engaging Kansas Prairie Webworks ("KPW," "we," "us," or "our") for any service, you agree to be bound by these Terms of Service. These terms govern all services provided by Kansas Prairie Webworks, including website design, Google Business Profile setup, Facebook Business Page setup, local SEO, monthly posting, and custom web application development.
If you do not agree to these terms, do not engage our services. These terms may be updated from time to time — continued use of our services after any update constitutes acceptance of the revised terms.
2. Services
Kansas Prairie Webworks provides digital marketing and web development services to small businesses primarily in Central Kansas. Services are described in detail on our website and in individual project agreements or invoices. Scope, pricing, and deliverables are confirmed in writing before work begins.
We reserve the right to decline any project or client relationship at our discretion.
3. Account Ownership Policy
You own everything we create or manage for you. This is a core principle of how we operate:
- Your domain name is registered in your name and under your control at all times.
- Your web hosting account belongs to you.
- Your Google Business Profile: we are added as Manager only, never Owner. You remain the Owner.
- Your Facebook Business Page: we are added as Admin only. You remain the Page Owner.
- All website files, content, and code created for you become your property upon final payment for one-time projects, or immediately upon project delivery for monthly clients.
Upon termination of services for any reason, we will remove ourselves from all managed accounts within 48 hours of notice. No content, listings, or accounts will be deleted or withheld.
4. Payment Terms
One-time projects require a 50% deposit before work begins and the remaining balance upon delivery. Monthly service plans are billed on a recurring monthly basis. All payments are due within 7 days of invoice. Late payments may result in paused services.
Refund eligibility for one-time projects is determined based on project stage at time of cancellation. Monthly services are refunded on a prorated basis for the unused portion of the current billing period, at KPW's discretion.
5. Cancellation Policy
Monthly services may be cancelled at any time with 30 days written notice. No early termination penalties apply. Upon cancellation:
- All accounts we manage will be returned to your control within 48 hours.
- All published work remains live and belongs to you.
- Monthly billing stops at the end of the current billing period.
KPW may terminate service to any client with 30 days notice, or immediately in cases of non-payment, fraud, abuse, or violations of these terms.
6. Intellectual Property
Upon full payment, all custom website files, code, and content created for your project become your property. Kansas Prairie Webworks retains the right to display completed work in its portfolio unless you specifically request otherwise in writing.
You represent that you own or have the legal right to use all content, photos, logos, and materials you provide to us for your project. You indemnify KPW against any claims arising from your provided materials.
7. KCPA Compliance
Kansas Prairie Webworks operates in compliance with the Kansas Consumer Protection Act (K.S.A. 50-623 et seq.). We do not engage in deceptive or unconscionable acts in our business practices. If you believe a violation has occurred, you may contact us directly or file a complaint with the Kansas Attorney General's Consumer Protection Division.
8. Limitation of Liability
Kansas Prairie Webworks is not liable for any indirect, incidental, consequential, or punitive damages arising from our services, including but not limited to lost business, lost revenue, or third-party platform changes (including changes to Google Business Profile or Facebook policies). Our total liability to any client shall not exceed the total fees paid to us in the preceding 90 days.
We are not responsible for downtime, data loss, or service interruptions caused by third-party hosting providers, domain registrars, or platform changes outside our control.
9. Third-Party Services
We may use or recommend third-party services (Formspree, Google Analytics, hosting providers, etc.) as part of our work. These services have their own terms and privacy policies. We are not responsible for changes to their terms, availability, or pricing. Any costs for third-party services are either disclosed in advance or billed directly to you by the provider.
10. Governing Law
These terms are governed by the laws of the State of Kansas. Any disputes arising from our services shall be resolved in Saline County, Kansas. Both parties agree to attempt good-faith resolution before pursuing legal action.
11. Website Hosting and File Ownership
Websites built by Kansas Prairie Webworks are hosted on KPW infrastructure under active service plans. Upon cancellation:
- Client receives a complete copy of all website files within 7 days at no additional charge.
- Domain names registered by KPW on the client's behalf may be transferred to the client's own registrar account upon written request. Transfer fees charged by the registrar are the client's responsibility.
- Website hosting ends 30 days after the final billing date.
- Facebook Business Pages and Google Business Profiles created or managed by KPW are transferred to full client control within 48 hours of cancellation. These accounts are always the client's property.
- KPW retains the right to display completed work in its portfolio unless the client requests otherwise in writing.
